Office space lease vs. legal situation related to COVID - 19

This Friday, March 20^th, 2020 at 11.00, Walter Herz is inviting everybody to another meeting of Tenant Academy, which for the first time will be organized in the form of a webinar. The subject of the video chat will be - Office space lease vs. legal situation related to the current epidemiological threat.

This time, Walter Herz specialists will share their knowledge and information about the current situation on the office market related to the implemented safety regulations. They will explain what mechanisms can be observed on the market today and what legal tools are available to tenants under these circumstances.

The on-line meeting is being organized in response to a wide interest in discussing changes in the commercial real estate segment and massive queries from tenants concerning this matter.

I. Legal aspects of the current situation - statutory regulations for emergency situations and the reality of commercial contracts, including:

a) Statutory bans on conducting specific activities on leased

space and landlord's right to demand full rent

b) Statutory and contractual grounds for lowering rent

c) Statutory and contractual grounds for terminating lease contracts

d) Grounds for amending lease agreements by courts in practice

e) How lease agreements may limit tenants in exercising their code rights

Procedural methods of implementing and securing the rights of parties to a lease agreement for the duration of court proceedings for a temporary or permanent change to the lease agreement.

III.

Landlord's responsibility for delays in handing over lease space and tenant's responsibility for the delay in making the existing (changed) premises available.

IV.

Tenants who have just moved to the new office, are in the middle of the rental period and are waiting for the landlord to hand over the space -what opportunities await them and threats do they have to face.

What best practices are currently used by landlords in their buildings and what solutions are being implemented by tenants.
